2. What data we collect and process

a) Contract data
We collect, process and store the data you provide when you order from us. In addition, we store and process data about the order and payment history.

b) Log data
When you visit our website, the device that you use to access the page automatically transmits log data to our server or our hosting provider. Our shop system also stores log data. Log information includes the IP address of the device that you use to access the Website, the type of browser you use, the website you have previously visited, your system configuration, and the date and time information. We store IP addresses only to the extent necessary to provide our services. Otherwise, the IP addresses are deleted or anonymized. We store your IP address when visiting our website for a maximum of 7 days to detect and ward off attacks.

c) Cookies
We use so-called session cookies. Session cookies are already deleted when you close your web browser. The session cookie tells your device a unique randomly generated ID. This will allow you to place an order on our website, use a shopping basket and assign language settings.
There are other types of cookies existing, but we refrain from using them.
You can prevent the setting of cookies at any time by means of an appropriate setting of your browser and thus permanently decide the settings for cookies. Furthermore, already set cookies can be deleted at any time via your browser. Disabling cookies makes it impossible to place an order.

d) Applicant data
We process the data that you specify in the application process. This includes your name, address, telephone and mobile numbers, e-mail addresses and the personal data resulting from your application documents.

 

3. Legal basis of processing

We process and use your data to fulfill the contract, to provide shipping as well as advice and for the billing. Art. 6 I lit. A GDPR serves as a legal basis for processing operations where we obtain consent for a particular processing purpose. If the processing of personal data are required to fulfill a contract, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our products or services. If we are subject to a legal obligation which requires the processing of personal data, such as the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary for the protection of our legitimate interests or that of a third party, unless the interests, fundamental rights and fundamental freedoms of the person concerned prevail. Such processing operations are particularly allowed to us because they have been specifically mentioned by the European legislator. A legitimate interest is usually to be assumed if the data subject is a customer of us.
If the processing of personal data is based on Article 6 I lit. f GDPR our legitimate interest lies in conducting our business.
We process applicant data in accordance with Art. 88 GDPR in conjunction with § 26 BDSG.

 

4. Categories of recipients

Processors:

a) Operation of the website: Our hosting company Host Europe GmbH, Hansestr. 111, 51149 Köln stores log data in accordance with the above information and to run the website in accordance with our legitimate interests under Art. 6 I lit. f GDPR.

b) Orders: We do not forward your personal data to the processor. However, we forward data if you instruct a payment to us via PayPal and / or instuct a shipment via DHL as part of an order:  

  • DHL. To enable the shipment as ordered, we provide the following data to DHL: the desired shipping address, your telephone number if it is a delivery to country outside Germany, the weight of the package.
  • Paypal. If you choose this payment method, our shop system transmits the order number as well as the scope of your order to PayPal and assigns it to your PayPal user account.

Further, we only release data to authorities and third parties in accordance with statutory provisions or a judicial title. Information to authorities may be provided on the basis of a legal security regulation or prosecution. Otherwise, third parties will only receive information if required by law.

 

5. Duration of storage

We only process and store personal data for the period required to achieve the purpose of storage or when required by law. These is, in particular, Art. 17 GDPR ("Right to be forgotten") as well as the applicable commercial and tax retention periods.

Data that you enter during the application process is stored for a maximum of six months.

 

6. Your rights

a) Information and confirmation right
You have the right to receive free information from us at any time as well as confirmation of your personal data and a copy of this information.

b) Right of rectification
You have the right to demand the immediate correction of incorrect personal data concerning you. You also have the right, under consideration of the purposes of processing, to request the completion of incomplete personal data, including by a supplementary statement.

c) Cancellation rights
You have the right to have your personal data deleted without delay if one of the following reasons applies and if processing is not required:

  • The personal data has been used for certain purposes or otherwise processed, for which they are no longer necessary.
  • You revoke your consent on which the processing was based on and their is no different legal basis for the processing given.
  • In accordance with Article 21 (1) of the GDPR, you object to the processing and there are no higher-ranking legitimate reasons for processing, or you object to the processing in accordance with Art. 21 (2) GDPR.
  • The personal data were processed unlawfully.
  • The deletion of personal data is required to fulfill a legal obligation under Union or national law to which we are subject.
  • The personal data were collected in relation to information society services offered pursuant to Art. 8 (1) GDPR.

d) Right to limit processing
You have the law to request the restriction of processing if any of the following conditions is met:

  • The accuracy of your personal information is contested by you for a period of time that allows us to verify the accuracy of your personal information.
  • The processing is unlawful, you refuse the deletion of the personal data and instead require the restriction of the use of personal data.
  • We no longer need your personal information for processing purposes, but you need it to assert, exercise or defend your rights.
  • You have entered an objection to the processing under Art. 21 para. 1 GDPR and it is not yet clear whether our legitimate reasons prevail over yours.

e) Opposition rights against processing
You have the right to object to the processing of your personal data under Article 6 (1) (e) or (f) of the GDPR every day.
In the event of an objection, we will no longer process personal data unless we can demonstrate compelling legitimate reasons for processing that outweigh your interests, rights and freedoms, or the processing is for the purpose of asserting, exercising or defending legal claims.
You have the right to object at any time to the processing of your personal data for the purpose of direct advertising.

f) Right to data transmission possibility
You have the right to receive the personal data relating to you and processed by us in a structured, common and machine-readable format. You also have the right to transfer this data to another person responsible without hindrance by us, if the processing is based on the consent pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract pursuant to Article 6 (1) (b) of the GDPR and when processing is done by automated procedures, unless the processing is necessary for the performance of a task in the public interest or in the exercise of official authority which has been entrusted to the controller.
Furthermore, in exercising your right to data portability under Article 20 (1) of the GDPR, you have the right to obtain that the personal data are transmitted directly from one controller to another, insofar as this is technically feasible and as far as that this does not confer rights and other people's freedoms.

g) Right to revoke a data protection consent
You have the right to revoke your consent to the use of personal data at any time.

h) Complaints to the supervisory authority
You have the right to contact a supervisor in the Member State of your whereabouts or work or the alleged violation at any time if you believe that the processing of your personal data violates the EU General Data Protection Regulation.

 

7. Existence of automatic decision-making / profiling

We do not use an automatic decision-making or profiling.
